DMCA Compliance Overview

SmallUseTools.com respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted a policy that provides for the removal of any infringing materials and for the termination, in appropriate circumstances, of users who are repeat infringers.

Important note: Our tools process files locally in your browser. We do not host, store, or transmit any user files on our servers. However, if you believe any content on our website (such as text, images, or code) infringes your copyright, please follow the procedure below.

Our Copyright Policy

We take copyright infringement seriously. Our policy includes:

  • Designating an agent to receive DMCA takedown notices
  • Responding promptly to valid infringement claims
  • Removing or disabling access to allegedly infringing content
  • Terminating repeat infringers in appropriate circumstances

Since our tools are browser-based and do not store user content, most DMCA concerns would relate to content we publish on our website (such as blog posts, tool descriptions, or images).

Submitting a DMCA Takedown Notice

If you believe that your copyrighted work has been copied, displayed, or used on our website in a way that constitutes copyright infringement, please provide our designated DMCA Agent with a written notice containing the following information:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

2. Identification of the copyrighted work claimed to have been infringed.

3. Identification of the material that is claimed to be infringing, including information reasonably sufficient to locate the material (e.g., the URL of the page containing the material).

4. Your contact information, including your address, telephone number, and email address.

5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Counter-Notification Procedure

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification. To be effective, a counter-notification must be a written communication provided to our DMCA Agent that includes substantially the following:

  • Your physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court in your district (or the district where you are located), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also limit access to our site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Misrepresentations

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages (including costs and attorneys' fees).
